1. Agreement Between Customer and Xecta Holdings LLC

By using this Website or booking through our agents, you agree to these Terms of Use (“Terms”), our Privacy Policy, and any applicable supplier rules. If you do not agree, do not use this Website or our services.

2. Right to Modify Terms

We reserve the right to update or change these Terms at any time without prior notice. Continued use of our Website or services after changes are posted constitutes your acceptance of the revised Terms.

3. Use of the Website

  • Be at least 18 years old and legally able to enter contracts.
  • Provide accurate and complete information.
  • Use the Website only for lawful travel bookings for yourself or those you are authorized to represent.

We may refuse service to anyone at our sole discretion.

4. General Rules & Conditions

4.1 Name Changes

Name changes are not permitted. Only the passenger named on the ticket may travel.

4.2 Cancellations & Refunds

  • All tickets are strictly non-refundable and non-changeable unless otherwise stated at the time of purchase.
  • Once issued, tickets cannot be altered, exchanged, or refunded under any circumstance, including but not limited to changes in travel plans, illness, or no-shows.
  • No refunds for partially used tickets.

4.3 Flight Schedule Changes

Airlines may change flight times without notice. Xecta is not responsible for missed connections, schedule changes, or cancellations.

4.4 Baggage

Baggage rules are set by airlines and may change without notice. Extra fees may apply.

4.5 Frequent Flyer Miles

Most discounted tickets are ineligible for frequent flyer miles or upgrades.

5. Supplier Rules & Third-Party Liability

Your booking is subject to the airline, hotel, or travel supplier’s terms. We act solely as an intermediary and are not liable for:

  • Service quality, changes, or cancellations by suppliers.
  • Acts, errors, or negligence of any airline, hotel, or third-party provider.

6. Travel Documents & Visa Requirements

You are solely responsible for ensuring you have all required travel documents, visas, and health certifications. No refunds will be issued for failure to meet entry requirements.

7. Cryptocurrency Payments

  • Pricing: Quoted in USD, converted at the rate at checkout.
  • Refunds: Crypto payments are final and non-reversible. If eligible, refunds may be in USD, in crypto at the original USD value, or as Xecta credit, at our discretion.
  • Wallet Accuracy: You are responsible for providing the correct wallet address. We are not liable for losses from errors or network issues.
  • Compliance: We may require identity verification.

8. Limitations of Liability

  • Our total liability for any claim will not exceed the total amount you paid to Xecta for the affected booking.
  • We are not liable for indirect, incidental, special, or consequential damages.
  • All travel is at your own risk. We are not responsible for delays, strikes, overbooking, weather, acts of God, or government actions.

9. Indemnification

You agree to indemnify and hold harmless Xecta, its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from:

  • Your breach of these Terms.
  • Your violation of any law or third-party rights.
  • Any action you take in connection with your use of our services.

10. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the State of Delaware, USA.
  • All disputes will be resolved by binding arbitration in Delaware, except that either party may bring an individual claim in small claims court.
  • No Class Actions: You agree to resolve disputes only on an individual basis, not as a plaintiff or class member in any class action or representative proceeding.
